This is a motion presented to the court where I point out to the court and the IRS that the tax must be assessed by the IRS and subject to the Civil Appeals Process before tax can be "due and owing." I was never willing to agree that tax was owed because I have steadfastly believed that no tax was owed and that the government could never prove tax was owed where a fair examination of the returns could be presented. The judge had insisted that I be represented by a public defender. The public defender demanded that I compromise. I refused and provided the defender with the motion. Of course the IRS Civil Appeals Office has now agreed with me.
